This Seller Agreement ("Agreement") is between you ("Seller," "you") and WildCard ("WildCard," "we") and governs your use of WildCard to list and sell dance costumes and dancewear. By checking the box on the listing form and submitting a listing, you agree to this Agreement for that listing.
WildCard connects sellers with buyers. Each sale is a transaction between you and the buyer — WildCard is not the manufacturer, owner, or merchant of record for anything you list, and does not inspect items in person before they ship.
You must be at least 18 years old to hold a WildCard seller account. If you're listing a costume that belongs to or was worn by a minor (for example, your dancer's outgrown costume), you as the account-holding adult are the Seller under this Agreement — the account, the listing, and this Agreement are yours, not your child's.
You're responsible for the accuracy of everything in a listing — brand, size, condition, included pieces, and any damage or wear you disclose. Listing an item you don't currently have in hand, in the condition described, is a violation of this Agreement and may result in the listing being removed, the sale being refunded, and/or your account being suspended.
Once a listing sells, you're responsible for shipping it within the window shown to you at the time (currently 7 days) using the label WildCard purchases on your behalf. If a shipment is not confirmed picked up by the carrier within that window, WildCard may automatically refund the buyer and relist the item, and repeated missed shipments may result in a temporary or permanent suspension of your ability to sell.
WildCard deducts a commission from each sale before paying you out — the exact rate depends on whether you choose to be paid in WildCard credit or cash, and is shown to you before you list. You choose your payout method per listing or as an account-wide default in your seller settings.
If you choose WildCard credit, it's added to your WildCard balance, never expires, and can be spent toward future WildCard purchases. It is not redeemable for cash and has no value outside WildCard. If you choose cash, it's sent to the bank account you connect through our payment processor once your sale is confirmed shipped.
You may not list counterfeit, stolen, unsafe, or recalled items, or use WildCard to circumvent fees by arranging payment outside the platform for a listing made here. WildCard may remove any listing or suspend any account that violates this Agreement or applicable law.
To the fullest extent permitted by law, WildCard's liability to you arising out of this Agreement or your use of WildCard is limited to the commission WildCard actually collected on the transaction giving rise to the claim. WildCard is not liable for indirect, incidental, or consequential damages. Nothing in this Agreement limits liability that cannot be limited under applicable law.
WildCard may update this Agreement from time to time. The version in effect at the time you submit a listing is the version that applies to that listing.
